General terms and conditions of sale for the online booking and payment service.

Article 1: Scope of application.

These general terms and conditions (GTC) apply without restriction or reservation to all services offered by Explurt.
The use of Explurt’s services implies the acceptance of these general terms and conditions and Explurt’s privacy statement (hereinafter article 12). They govern the contractual relations of Explurt, its website, namely

the validated reservation of the client and/or passenger with a driver guide affiliated with or commissioned by Explurt.

the service provided by the driver guide.

It is specified that the guide-driver is certified; he performs the service on his own account and is responsible for the provision of transport and service.

Explurt will put in place the necessary means to deliver a quality service. Explurt will act as an intermediary.

As a consumer, you can access the online platform, confirming where applicable that you are of legal age to use or participate in the service or offer concerned.

Where applicable, such consumers may be:

either a passenger, a natural person directly benefiting from the booking and connection service provided by Explurt.

or a natural or legal person, ordering the booking and connection service provided by Explurt, in his name and on his behalf, in order to allow his own clients or principals to benefit from it, free of charge or not.

 The use of Explurt’s services is governed by the terms and conditions of the contract under which the services are obtained.

Except as expressly stated in these terms of use, no part of the site or any content may be copied to any other computer, server or website for publication or distribution for any commercial enterprise without the prior consent of Explurt.

Explurt reserves the right to change, supplement or delete parts of these terms of use. It is your responsibility to check these terms of use for any changes.

Article 2: Formation of the order.

2.1 The client can book a travel service from Explurt by placing an order

via the website  https://www.explurt.com

2.2 All orders made by the Client are subject to the written acceptance of Explurt.

An order for travel services is accepted upon receipt by the client of a written acknowledgement of receipt from Explurt. Confirmation and validation are sent by e-mail after receipt of the full deposit due in accordance with the terms set out below.

 

Article 3: Validity and modification of the order.

In order for the order to be valid, the Client must have filled in the booking form correctly and completely and the booking must have been formally accepted by Explurt.

In the event of fraudulent, erroneous or missing information on the part of the Customer, the order cannot be validated by Explurt.

 

Article 4: obligations

You are responsible for complying with all applicable laws, rules, regulations and civic, criminal and legal obligations (referred to as “customs and laws”); applicable to your use of the Explurt Platform.

Users of Explurt agree to cooperate with Explurt. Explurt prohibits any inappropriate and or offensive behaviour. Explurt has the right to check, disable or modify the content of members in order to protect and improve the security of the platform.

 

Article 5: Payment conditions

Payment by the client for the services ordered from Explurt is made in full at the time of ordering by credit card.

 

Article 6: Right of withdrawal

The cancellation of the travel order is made by the client via the internet on the platform, on its social networks, by phone or by email. The reservation number is required.

In case of cancellation, the customer will be charged an amount established in proportion to the period of abandonment.

 

Article 7: Prices

Explurt charges €3 per traveller for the connection.

The prices of the travel services offered by Explurt are those in force on the day the order is placed. For the services offered by Explurt, Explurt applies a price revision, Explurt reserves the right to apply requests for increases, decreases or price freezes.

The prices provided by Explurt are expressed in euros, exclusive of tax and VAT.

 

Article 8: Description of the service

The service is an order for a travel service from a certified employee.

It applies the standards of the service procedures. (see documentation on the service provider’s procedure)

Clients are authorised to transport any type of luggage within the limits of the vehicle’s capacity and at no extra cost.
Pets must be notified at the beginning of the trip or when booking the trip.

 

Article 9: Responsibility of the provider

The provider is in charge of the trip, he organizes the trip. The provider takes care of the guide book, the grouping and the administration of the route, he is your trip captain.

 

Article 10: Customer’s responsibility

The customer is responsible for his conduct and for respecting the “customs and laws” of his place of dispatch.

Identity documents are required to enter a destination country. Some countries require a minimum validity available in your passport. Make sure you respect the time required to clear customs.
Keep your travel documents up to date.

Some luggage is not allowed on planes. These are indicated at the airport. Explurt is not responsible for any violation of the rules.

The client is responsible for his personal belongings and keeps them in his custody. He/she must make sure that nothing is forgotten when travelling.

 

Article 11: Disputes

In the event of a dispute, an amicable solution shall be sought before legal action is taken. The prior search for an amicable solution shall not interrupt the time limits for taking action in warranty.

All disputes to which the present contract may give rise, concerning its validity, interpretation, execution, termination, consequences and consequences, shall be submitted to the judicial courts, which the client accepts.

 

Article 12: Intellectual property and personal data protection 

The content, form, title and all the elements contained on the Explurt website are protected worldwide under copyright and trademark law. In particular, its visual and graphic charters, texts, photographs, diagrams, illustrations, logos, trademarks and other distinctive signs, as well as any databases appearing on the site, are the property of Explurt.

Any total or partial reproduction of one or more elements of the content is strictly forbidden and is likely to constitute an infringement of copyright, unless Explurt has given its express prior written consent.

 

Article 13: Personal data

It is recalled that the personal data requested from the customer is necessary for the processing of his order and the establishment of his invoice.

Where applicable, all information relating to orders for travel services is recorded for the purposes of proof, particularly with regard to:

The customer’s surname, first name and address.

The telephone number presented by the customer as well as his/her e-mail address.

The details of the requested trip.

In accordance with the national and European regulations in force, the customer has a permanent right of access, modification, rectification and opposition with regard to the information concerning him/her.

 

Article 14: Force majeure

Explurt is not legally or morally liable for the non-performance or delay in the performance of any of its obligations if this is due to an event beyond its control.

Explurt ensures the certification of guides, the compliance of travel standards, and the connection of the client with the guide. We ensure that we provide a contact and support service.
